On Sunday, a seven-minute video of a woman allegedly being DJ Brownskin’s wife ingesting poison went viral.
The video purporting to have been recorded by the husband has since caused a public outcry.
Sharon Njeri is seen sending her final message to her family before falling on the ground and her child attempts to give her milk before she dies.
Various lawyers have since gave their comments on the legal implications and the possible charges that could be involved.
There is no case to answer. The penal code does not provide for such unless it is proven that the Dj aided the suicide as expressly stipulated in Section 225 of the Penal code
Bill Omondi
Evidence
Speaking to Lake Region Bulletin Lawyer Bill Omondi noted that the case had little to no legal parameters but was perceived to be more of a moral standpoint.
“There is no case to answer. The penal code does not provide for such unless it is proven that the Dj aided the suicide as expressly stipulated in Section 225 of the Penal code,” said Omondi.
“The scenario tends to lean more on moral fabric,” he furthered.
The circumstances putting the DJ at the scene of the commission of the offence, circumstantially, he was aware that an offence was going to be committed
Danstan Omari
Felony
Lawyer Danstan Omari however had a different stand.
He argues that argues that the circumstances that put the DJ at the scene of the commission of the offense suggest that he participated in preparation for the commission of an offense.
“The circumstances putting the DJ at the scene of the commission of the offence, circumstantially, he was aware that an offence was going to be committed,” he said.
In addition to aiding suicide, Omari said the DJ violated Article 53 of the Constitution, Section 119 of the Children’s Act exposing children to horrid circumstances.
“He recorded the offence. He must have discussed in advance what is going to be done. He knew the content of the poison the lady wanted to take. So, he participated in the preparation for the commission of an offence.”
Kenyans online are now calling on the police to investigate the matter.
