Nairobi High Court has granted the Directorate and Criminal Investigation (DCI) to use the report on the three Venezuelans arrested in the country on July 21st in the Azimio Supreme Court petition.

Azimio presidential running mate, Martha Karua moved to the court seeking to have the DCI report admitted as evidence in the case seeking to overturn declaration of William Ruto as president elect.

Justice Hedwig Ongu’ndi directed DCI to present the evidence to Karua within 12 hours.

Upon perusal of the pleadings, supporting affidavit and annexures, I am satisfied that the main prayer sought in the notice of motion is merited to enable the petitioner file her documents at the Supreme Court

Justice Hedwig Ongu’ndi

“Upon perusal of the pleadings, supporting affidavit and annexures, I am satisfied that the main prayer sought in the notice of motion is merited to enable the petitioner file her documents at the Supreme Court,” read Justice Ongu’ndi’s ruling.

The evidence

The evidence alleged that the three Salvador Javier Suarez, Jose Castellano and Joel Garcia had access to key election materials.

According to the DCI the trio were able to access the KIEMS kit, data on the deployment of election technology and passwords of the IEBC personnel.

This is the evidence that Azimio will be presenting against Independent Electoral and Boundaries Commission (IEBC).

The coalition will be seeking to prove that the foreigners accessed the system and manipulated the results.
