Murang’a County Woman Representative Sabina Chege on Tuesday skipped a grilling session by the IEBC over her voter rigging claims.
Through legal team, Chege presented a statement to the electoral body, claiming that she had been admitted in Nairobi Hospital from February 16, and could not honour the summon.
Lawyer Otiende Amollo asked the IEBC Code of Conduct Committee to reschedule the meeting to a later date when the legislator is out of hospital.
The legislator further said that she was in pursuit for justice as to whether the Independent Electoral and Boundaries Commission (IEBC) had powers to summon her over the remarks.
The IEBC had accused her of violating the electoral code of conduct after her utterances during a rally in Vihiga on February 10, 2022 in which she claimed that the 2017 polls were rigged in favour of President Uhuru Kenyatta.
Senior Counsels James Orengo and Otiende Amollo while representing Chege in the previous meeting argued that the breach set out in the statement did not meet the constitutional matters and it was not clear what the charges were.
“The only thing is to withdraw from this matter and this will not be the end of the investigation. The breach set out in the statement do not meet constitutional matters. The words in the breach cannot be substance to enter into inquiry. The commission do not have jurisdiction on this matter,” Orengo said.
