Arror and Kimwarer dams case to proceed to full hearing

A petition by former Treasury CS Henry Rotich seeking to withdraw charges leveled against him in the Arror and Kimwarer dams scandal has been dismissed.

This means the case against the ex-CS and four others over alleged misappropriation of Sh63 billion will go to full hearing.

According to the Director of Public Prosecutions (DPP), the court upheld the accusations ruling for the continuation of the hearing of the case.

“The ruling affirmed the DPP‘s position that the charges were properly instituted by the office which has powers to institute criminal charges under Article 157 of the constitution,” a statement by the DPP stated.

In the fraud case, Rotich is accused of misappropriation of public funds relating to the construction of the multi-billion project.

He will also be charged alongside four others for jointly conspiring in fraud, abuse of office and failure to comply with various sections of the law while carrying out government contracts.

The case will be heard on March 23, 2022.
